Dram Shop Liability
Minnesota Dram Shop Liability Lawyer
If someone is stupid enough to get behind the wheel after a night out at the pub, then that person should be held responsible for his own actions, including any accidents he causes on the road. And, in most instances, he will. If a drunk driver causes an accident, he may be facing serious jail time, hefty fines and license suspension as well as a criminal conviction. However, this does little to help the victim and the family of the victim. A drinking and driving lawsuit, however, will help you pay for the losses experienced due to this reckless and irresponsible behavior. One of the options for filing a drinking and driving lawsuit is a dram shop lawsuit.
Under the state of Minnesota, establishments that serve alcoholic beverages may be held responsible for any accidents these beverages cause if the alcohol was bought illegally. This is called the dram shop law, named after a unit of measurements that spirits were originally sold in.
What is Dram Shop Law?
Dram shops are any tavern, bar, pub, liquor store or other facility that sells liquor. Under the Minnesota Dram shop laws, the establishment may be held liable for the illegal sale of alcohol which directly results in the injury of another person. For example, if a beer and wine store sells a six pack to an already intoxicated person and he gets into his car and causes a serious accident, the victims of that accident may have a case under the Dram shop law.
But what is the illegal sale of alcohol? Under Minn. Stat. § 340A.801 the illegal sale of alcohol includes:
- any sale to a minor
- any sale to an obviously intoxicated person,
- any sale on a day prohibited by law or during hours prohibited by law,
- any sale to nonmembers or guests of a club.
Who is Eligible for Compensation?
If you injure or kill yourself after you have been drinking at an establishment, you cannot file a lawsuit under the dram shop law; however, your loved ones may have a case if they have lost income because of this accident.
If you have been injured or someone you love has been killed due to a drinking and driving accident after the illegal sale of alcohol, you may file a claim under the dram shop law
Drinking and driving accidents kill thousands of people every year and injure thousands more. After the alcohol has worn off and the damages assessed there are often medical expenses, recovery expenses and a loss of income if unable to work. In many instances the family will also need to look at funeral and burial costs if the accident resulted in a fatality. These financial burdens are the last thing anyone wants to think about, especially when coming to terms with the physical and emotional turmoil the accidents has caused.
