For example, if you have been involved in an automoble accident, Minnesota law states that all drivers owe others a duty of reasonable care. In order to file a bodily injury claim, it must be proven that the driver that caused the accident failed to meet that duty.  Minnesota law also states that an individual’s injuries must meet or surpass a tort threshold. A bodily injury claim can be brought against the at-fault driver if one of the following thresholds is met:

  •     There was a fatality; or
  •     Injuries led to disfiguring injuries; or
  •     Injuries led to permanent disability; or
  •     Caused you to miss over sixty days of work; or
  •     Led to medical expenses in excess of $4,000.

The Statute of Limitations in Minnesota for automobile accidents is six years for bringing a claim, however, it is important to contact our attorneys to discuss the circumstances regarding your accident and injuries to make sure that you have all the tools and information necessary to make a sound legal decision.

Cases other than automobile accidents each carry their own deadline for filing a claim.  You should discuss any questions you have with our knowledgeable attorneys and get your questions answered.
